Welcome to Pawhaven. “We,” “us,” and “our” refer to Pawhaven, operated by Servet Altinkaynak. We operate this store and website, including the related information, content, features, tools, products, and services (the “Services”). Our store is powered by Shopify.

These Terms of Service, together with the policies referred to here, describe your rights and responsibilities when using the Services. Please read them carefully, including the warranty disclaimers and liability limitations. By visiting or using the Services, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Services.

1. Access and account

You represent that you have reached the age of majority in your state or place of residence. You are responsible for supervising any minor dependents whom you allow to use devices under your control to access the Services.

You may need to provide your email address and billing, payment, and shipping details. You represent that all information you provide is accurate, current, and complete and that you have the right to provide it.

You are responsible for safeguarding your account credentials and all activity under your account. You may not transfer, sell, assign, or license your account to another person.

2. Our products

We aim to present our pet products accurately. Colors and appearance may vary depending on your device and display settings. We cannot guarantee that every display reproduces a product’s appearance precisely or that a product will meet your personal expectations. This does not limit rights relating to defective or misdescribed goods.

Product descriptions may change without notice. We may discontinue products or limit quantities offered to particular people or regions. Choose products appropriate for your pet’s size and intended use and follow supplied care and safety instructions.

3. Orders

Placing an order constitutes an offer to purchase. We may accept or decline an order, subject to applicable law. An order is accepted when we confirm acceptance and have received and processed payment. Review your order carefully before submitting it; cancellation requests may not be possible once an order has been accepted or dispatched.

If we decline, change, or cancel an order, we will attempt to notify you using the contact details provided. Payments for canceled items will be refunded. Returns and exchanges are governed by our Return & Refund Policy, without limiting rights provided by law.

Purchases are intended for personal or household use, not commercial resale or export.

4. Prices and billing

Prices are displayed in US dollars (USD). Prices, discounts, and promotions may change; the price applicable to your purchase is the price shown when you place your order and in your confirmation. Applicable taxes and any charges will be shown at checkout before you pay. Standard shipping to eligible US addresses is free as described in our Shipping Policy.

Prices may differ from those offered by other sellers. Promotions may have separate terms, which apply to that promotion if they conflict with these Terms.

Provide accurate and current payment, purchase, and account information and update it when necessary. You represent that you are authorized to use your selected payment method and agree to pay the order total, including applicable taxes. See our Payment Policy.

5. Shipping and delivery

Processing and delivery estimates, order cutoff times, and address restrictions appear in our Shipping Policy. Delivery dates are estimates and can be affected by carrier delays, severe weather, or other events beyond our control.

If we cannot ship within the stated time, we will notify you and offer the choice of agreeing to a revised shipment date or canceling for a prompt refund. Contact us about lost, damaged, or undelivered packages so we can investigate. Nothing in these Terms removes rights or remedies available under applicable consumer law.

6. Intellectual property

The Services, including their text, illustrations, images, graphics, reviews, videos, audio, trademarks, design, selection, and arrangement, are owned by Pawhaven or its licensors and are protected by applicable intellectual property laws.

You may use the Services for personal, noncommercial purposes. Except as permitted by law or our written consent, you may not reproduce, distribute, modify, display, perform, republish, download, store, or transmit their content. These Terms do not grant rights to our intellectual property or that of Shopify or other parties beyond the limited use described here.

Pawhaven names, logos, designs, and slogans belong to their respective owners or licensors. Shopify’s names and marks belong to Shopify. Other names and marks belong to their respective owners. Unauthorized use is prohibited.

7. Optional tools

We may provide access to third-party tools that we do not monitor or control. Such access is provided “as is” and “as available,” without endorsement or additional warranties, to the extent permitted by law.

Your use of optional tools is at your discretion and subject to the relevant provider’s terms. Review those terms before using a tool. New features or resources introduced through the Services are also subject to these Terms.

8. Third-party links

The Services may include third-party materials, embedded features, or links. We do not control these websites and are not responsible for their content, accuracy, policies, or practices. Review the third party’s terms before making a purchase or providing information.

Questions or complaints about third-party products or services should be directed to that provider. Our responsibility is limited only to the extent permitted by applicable law.

9. Relationship with Shopify

Pawhaven is powered by Shopify, which enables us to provide the Services. However, purchases made in our store are made directly with Pawhaven. By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and Pawhaven, including injuries, damage, or loss arising from purchased products or services. To the extent permitted by law, you release Shopify and its affiliates from claims, damages, and liabilities arising from your purchases and transactions with Pawhaven.

10. Privacy

Personal information collected through the Services is subject to our Privacy Policy. Some information is also subject to Shopify’s Privacy Policy. By using the Services, you acknowledge these policies.

Shopify hosts the Services and processes information about your access and use to provide and improve them. Information may be transferred to Shopify and other providers in countries outside your country of residence. Our Privacy Policy explains this in more detail.

11. Feedback

If you submit ideas, suggestions, reviews, concepts, plans, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, adapt, publish, distribute, and display that Feedback to operate, evaluate, improve, and promote the Services, including for commercial purposes.

You represent that you hold the necessary rights, have disclosed any compensation or incentives connected with your Feedback, and comply with these Terms. We are not required to keep Feedback confidential, compensate you, or respond.

We may monitor, edit, or remove unlawful, abusive, threatening, defamatory, obscene, or otherwise objectionable Feedback or material that violates rights. Your Feedback must not infringe intellectual property, privacy, or other rights or contain malware. Do not impersonate others, use a false identity, or misrepresent the origin of Feedback. You are responsible for its content and accuracy.

12. Errors, inaccuracies, and omissions

Information may occasionally contain errors concerning descriptions, prices, promotions, shipping charges, delivery estimates, or availability. We may correct errors and update information. If an error affects an existing order, we may contact you or cancel and refund the affected order as permitted by law. Changes will not override mandatory consumer rights.

13. Prohibited uses

Use the Services only for lawful purposes. Do not violate laws, infringe intellectual property or other rights, harass or harm others, submit misleading information, distribute prohibited content or spam, impersonate another person, or interfere with another person’s use of the Services.

Do not upload malware, exploit or resell the Services without permission, collect or track personal information unlawfully, engage in phishing or fraudulent conduct, scrape or crawl the Services without authorization, or bypass security measures. We may suspend or terminate access for violations, subject to applicable law.

14. Termination

We may terminate this agreement or access to all or part of the Services as permitted by law. You remain responsible for amounts properly due up to the termination date.

Provisions that by their nature should survive termination will continue, including intellectual property, Feedback, warranty disclaimers, liability limitations, indemnification, severability, entire agreement, assignment, governing law, and privacy provisions.

15. Disclaimer of warranties

Information provided through the Services is for general information. To the extent permitted by law, we do not warrant that it is always accurate, complete, or useful.

Except as expressly stated by us and subject to nonwaivable legal rights, the Services and products are provided “as is” and “as available,” without additional express or implied warranties, including merchantability, fitness for a particular purpose, durability, title, or noninfringement. We do not guarantee uninterrupted, timely, secure, or error-free service. Some jurisdictions do not allow certain warranty exclusions, so those exclusions may not apply to you.

16. Limitation of liability

To the fullest extent permitted by law, Pawhaven, its owner, affiliates, partners, employees, agents, contractors, service providers, and licensors, and Shopify and its affiliates, will not be liable for indirect, incidental, punitive, special, or consequential losses, including lost profits, revenue, savings, data, or replacement costs arising from your use of the Services or products.

These limitations apply regardless of the legal basis of a claim and whether the possibility of such loss was communicated. They do not exclude liability or remedies that cannot lawfully be excluded, or reduce mandatory rights available to you as a consumer.

17. Indemnification

To the extent permitted by law, you agree to defend and indemnify Pawhaven, Shopify, and their respective affiliates, personnel, agents, contractors, licensors, and service providers against third-party claims, losses, liabilities, and reasonable legal fees arising from your breach of these Terms, violation of law or third-party rights, or misuse of the Services.

We will notify you of a covered claim. A delayed notice will relieve your obligations only to the extent it materially prejudices you. We may manage the defense and settlement with chosen counsel, but will not agree to a settlement imposing nonmonetary obligations on you without your consent, which must not be unreasonably withheld. You agree to reasonably cooperate in the defense.

18. Severability

If a provision is unlawful, void, or unenforceable, it will apply to the maximum extent permitted by law and the unenforceable part will be severed. The remaining provisions will continue in effect.

19. Waiver and entire agreement

Failure to enforce a right or provision is not a waiver. These Terms and the policies incorporated into them constitute the agreement governing your use of the Services and replace earlier communications or agreements on that subject, except where applicable law requires otherwise.

20. Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent. We may transfer our rights and obligations where permitted by law, without reducing your applicable consumer rights.

21. Governing law

Pawhaven is operated by Servet Altinkaynak from Germany. These Terms are governed by the laws of Germany, subject to mandatory consumer protections that apply in your US state or other place of residence. Nothing in these Terms deprives you of nonwaivable rights or access to courts available under applicable law. The US warehouse address does not change the identity or location of the business operator.

Headings are for convenience only and do not limit or otherwise affect these Terms.

23. Changes to these Terms

The current version is available on this page. We may update these Terms by posting a revised version and will notify you of material changes as required by law, including their effective date. Continued use after changes take effect constitutes acceptance to the extent permitted by law.
